1. Acceptance of Terms

By downloading, installing, or using PeaceBreak, you agree to be bound by these Terms. If you do not agree, do not use our service. These Terms constitute a legally binding agreement between you and us.

Legal Document Acceptance Records

When you accept our Terms of Service, Privacy Policy, and Refund Policy, we maintain comprehensive records of your acceptance for legal compliance and dispute resolution purposes. These records include:

• Your email address and user identification
• Device information (device ID, device name/model, platform, system version, build number)
• IP address at the time of acceptance
• User agent and application version information
• Timestamp of acceptance
• Document version and type accepted

These records serve as evidence of your acceptance of our legal terms and may be used in the event of disputes regarding terms acceptance or legal compliance requirements.

2. Service Description

PeaceBreak is a wellness and relaxation application that helps you create peaceful moments in your day through:

• Shake to play: Shake your device to instantly play calming audio
• Scheduled breaks: Set automated peace breaks throughout your day
• Curated audio library: Access to high-quality nature sounds, ambient tracks, and peaceful audio
• Customizable interface: Beautiful, customizable user interface options

Important: Our audio content includes publicly-licensed tracks, self-recorded sounds, and purchased audio. Some artwork may be AI-generated.

3. Account & Age Requirements

• You must be at least 16 years old to create an account
• You must provide a valid email address
• You are responsible for maintaining the confidentiality of your account
• One account per person; sharing accounts is prohibited
• You must notify us immediately of any unauthorized use of your account

4. Subscription & Payment Terms

All subscriptions are billed and processed exclusively through Square; PeaceBreak does not use Google Play or Apple App Store billing.

Pricing and Modifications:

• Current subscription rates:
  • Monthly: $3.99 USD per month
  • Annual: $39.99 USD per year (save 16%)
• Price changes will be communicated at least 30 days in advance
• Applicable taxes may apply based on your jurisdiction
• No refunds for partial billing periods (refer to our Refund Policy for complete details)

5. Acceptable Use

Prohibited Activities:

• Using PeaceBreak for any illegal or unauthorized purpose
• Reverse engineering, decompiling, or attempting to extract source code
• Sharing your account credentials with others
• Uploading malicious code, viruses, or harmful content
• Interfering with or disrupting our services or servers
• Using automated tools, bots, or scripts to access the service
• Violating any applicable local, state, national, or international law

6. Intellectual Property

• The PeaceBreak app software and original content created by us is our intellectual property
• Some content includes third-party materials used under appropriate licenses (publicly-licensed audio, downloaded images, AI-generated content)
• You receive a limited, non-exclusive, non-transferable license for personal use only
• You may not redistribute, sell, rent, or commercially exploit any app content
• The PeaceBreak name and branding are our protected intellectual property
• Our audio library consists of publicly-licensed tracks, self-recorded sounds, and purchased content

7. Service Availability

• We strive for reliable service but cannot guarantee 100% uptime
• We may temporarily suspend service for maintenance, updates, or security
• We reserve the right to modify, suspend, or discontinue features with reasonable notice
• Critical service changes will be communicated at least 30 days in advance

8. Platform Permission

• Notifications are used to show what’s playing and helpful status information.

8. Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PeaceBreak is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
• We do not warrant that the service will be uninterrupted, error-free, or completely secure
• We do not guarantee that PeaceBreak will meet your specific requirements or expectations
• Your use of PeaceBreak is at your own risk

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for loss of profits, data, use, goodwill, or other intangible losses
• These limitations apply regardless of the legal theory (contract, tort, or otherwise)
• Some jurisdictions do not allow these limitations, so they may not apply to you

10. Indemnification

You agree to indemnify, defend, and hold harmless Thamizhi Studios, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use or misuse of PeaceBreak
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the service

11. Termination

• You may cancel your account at any time through the app
• We may suspend or terminate your account for violations of these Terms
• We may terminate the service entirely with 30 days notice
• Upon termination, your right to use PeaceBreak ceases immediately
• Sections regarding liability, indemnification, and governing law survive termination

Account Deletion & Re-Registration

If you delete your PeaceBreak account and later sign in with Google again, our authentication provider (Supabase) will automatically create a new account. This does not restore previously deleted data; you will start fresh.

12. Changes to Terms

We may update these Terms periodically. Significant changes will be communicated through the app or email at least 30 days before they take effect. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law & Jurisdiction

• These Terms are governed by the laws of the State of New Hampshire, USA
• Any disputes will be resolved in the state or federal courts located in New Hampshire
• You consent to the personal jurisdiction of these courts
• This choice of law applies regardless of conflict of law principles

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to be enforceable while preserving the original intent as much as possible.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding PeaceBreak. No other communications or agreements override these Terms unless explicitly agreed to in writing.
